BoothKit is operated by Focus Pocus Productions LLC (“Company,” “we,” “us,” or “our”). By accessing this website or purchasing any product, you agree to these Terms.

2. Digital Products & License

All digital products sold on BoothKit are licensed, not sold. Your purchase grants you a limited, non-exclusive, non-transferable license to use the purchased digital asset (“Work”) in accordance with the terms below. This license applies only to digital products. Any physical goods, tangible merchandise, or printed items sold through the website are not governed by the digital license terms outlined below.

3. Standard License Agreement

Single Business License

This license is valid for one business entity only. If you operate multiple legally separate businesses, franchises, or independent locations, each entity must purchase its own license. The Work may not be shared across separate companies or business entities.

Permitted Use

You may:

  • Use the Work in your photo booth events and activations
  • Incorporate the Work into client projects
  • Modify the Work for your own event use
  • Produce unlimited final outputs (prints, videos, microsites, event deliverables)

You may charge your clients for services that include use of the Work and recover the cost of purchase as part of your service pricing.

Prohibited Use

You may not:

  • Resell, sublicense, redistribute, gift, or trade the Work
  • Share the Work via cloud drives, file-sharing platforms, or online communities
  • Include the Work inside another digital product, template, bundle, or system for resale
  • Claim the Work as your own creation
  • Transfer the original layered or editable files to any third party

Modified versions of the Work remain subject to this license and may not be redistributed.

Digital Product Restriction

The Work may not be incorporated into any digital asset, overlay, template, filter, VFX system, microsite, or similar product intended for resale or distribution. This license permits event use only — not product redistribution.

4. Software Compatibility

BoothKit products are developed, tested, and guaranteed using the software versions specified at the time of release. Customers are responsible for verifying compatibility with their current software version prior to purchase. While we make reasonable efforts to maintain compatibility with major software updates, future compatibility cannot be guaranteed due to changes made by third-party software providers. If a product becomes incompatible due to a software update, BoothKit will make reasonable efforts to provide a fix or compatibility update at no additional charge where feasible. In cases where a major software change requires a complete rebuild or structural redesign, an updated version may be released as a new product or paid upgrade. Refunds will not be issued due to incompatibility resulting from software updates released after the date of purchase.

5. Refund Policy

Due to the digital nature of our products, all sales of digital products are final and non-refundable. Please review product descriptions and compatibility information carefully before completing your purchase. Custom-built or modified physical and digital products are non-refundable. Physical or tangible products, if offered, may be subject to separate return or exchange policies stated on the product page.

6. Intellectual Property

All digital products, templates, graphics, and digital assets remain the intellectual property of Focus Pocus Productions LLC. You do not acquire ownership rights to any product, whether modified or unmodified.

7. No Warranty

All products and website content are provided “as is” without warranty of any kind, express or implied. We do not guarantee uninterrupted access to the website or error-free performance of digital products.

8. Limitation of Liability

To the maximum extent permitted by law, Focus Pocus Productions LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from:

  • Use or inability to use our products
  • Software incompatibility
  • Loss of data
  • Business interruption

In no event shall our total liability exceed the amount paid for the product in question.

9. Payments

By purchasing from BoothKit, you represent and warrant that:

  • The payment information provided is accurate and complete
  • You are authorized to use the payment method submitted
  • You agree to pay all charges, including applicable taxes

10. Governing Law

These Terms shall be governed by the laws of the State of Florida, United States.
